Maxton Design Gift Card – Terms and Conditions

Glossary

  1. Issuer – Maxton Design sp. z o.o., ul. Podlesie 26, 32-830 Wojnicz, Poland, NIP PL7831852502, KRS 0000955679, REGON 521309872, the issuer of the Gift Card and the seller fulfilling orders paid with it.
  2. Store – the online store at www.maxtondesign.com, available in Polish, English, French and German.
  3. Gift Card – an electronic voucher with a unique code, issued by the Issuer in a specific currency, which can be used as a means of payment for orders placed in the Store.
  4. Currency of the Gift Card – the currency in which the Gift Card was purchased: Polish zloty (PLN) or euro (EUR).
  5. Buyer – a natural person, legal person or organisational unit without legal personality, with full legal capacity, who purchases a Gift Card in the Store.
  6. User – any person in possession of the Gift Card code.
  7. Balance – the amount currently available on the Gift Card, expressed in the Currency of the Gift Card.
  8. Products – goods offered in the Store.

§1. General provisions

  1. The Issuer undertakes to issue the Gift Card to the Buyer and to accept it as payment in the Store in accordance with these Terms.
  2. The Gift Card is offered in the Store as a separate product for each currency: PLN and EUR. Gift Cards are offered only in Poland and on the Store's European market. The available nominal values are shown on the Gift Card product page.
  3. The Gift Card is purchased by placing an order in the Store. Its price is equal to its nominal value and is paid in the Currency of the Gift Card.
  4. After the payment is confirmed, the Gift Card code is sent to the e-mail address provided in the order. Where the Store allows it, the Gift Card may instead be sent to a recipient indicated by the Buyer, on a date chosen by the Buyer.
  5. A Gift Card cannot be purchased using another Gift Card.
  6. The Gift Card is valid for 12 months from the date the Gift Card is issued. Within that period it may be used until its Balance is fully used up. After the expiry date, any remaining Balance can no longer be used, subject to §3. The expiry date is shown in the Gift Card e-mail and on the Gift Card page.
  7. The Gift Card can only be used in the Store. It cannot be used with the Issuer's dealers or distributors, or on other sales channels (e.g. marketplaces).
  8. The Gift Card cannot be exchanged for cash, in whole or in part, except as provided in §3.
  9. The Gift Card is a bearer instrument, and anyone who knows its code may use it. The User should keep the code confidential.
  10. The Issuer is not liable for the loss, theft or disclosure of the code, unless due to the Issuer's fault.
  11. The Gift Card is not a payment instrument within the meaning of the Payment Services Act.

§2. Using the Gift Card

  1. To use the Gift Card, the User enters its code at checkout in the field intended for gift cards or discount codes.
  2. The Gift Card can only be used for orders placed in the Currency of the Gift Card. For example, a PLN Gift Card can only be used for orders paid in PLN.
  3. The Gift Card may be used many times. With each order, the Balance is reduced by the amount paid with the Gift Card, and the remaining Balance stays available for further orders until the expiry date.
  4. The Gift Card may be used to pay the full amount due for an order, including Products, shipping costs and applicable taxes.
  5. If the amount due exceeds the Balance, the User pays the difference using another payment method available in the Store.
  6. More than one Gift Card in the same currency may be used in a single order.
  7. The Gift Card may be combined with discount codes and promotions available in the Store, unless the terms of a given promotion state otherwise. Discounts are applied first, and the Gift Card is then used to pay the remaining amount.
  8. The User can check the Balance and expiry date:
    1. on the Gift Card page, accessible via the link in the Gift Card e-mail;
    2. at checkout, after entering the code;
    3. by contacting the Issuer at sales@maxtondesign.eu.
  9. The Issuer may refuse to accept the Gift Card if:
    1. its Balance is zero or it has expired;
    2. the order is placed in a currency other than the Currency of the Gift Card;
    3. the code has been deactivated under §4;
    4. accepting the Gift Card is technically impossible for reasons not attributable to the Issuer.

§3. Returns, withdrawal and complaints

  1. The provisions of this section do not limit any rights granted to consumers by law.
  2. If the User withdraws from an order paid in whole or in part with a Gift Card, returns Products, or a complaint is accepted, the Issuer refunds the amount due as follows:
    1. the part paid with the Gift Card is returned to the same Gift Card, up to the amount paid with it;
    2. any remaining part, paid with another payment method, is refunded to that payment method.
  3. Where several Gift Cards were used in one order, the refund is returned to each Gift Card up to the amount paid with it. If a Gift Card has expired by the time of the refund, the Issuer issues a new Gift Card in the same currency for the refunded amount, valid for 12 months.
  4. A Buyer who is a consumer, or an entrepreneur entitled to consumer rights under Polish law, may withdraw from the purchase of an unused Gift Card within 14 days of its purchase. In that case, the Issuer refunds the price using the original payment method and deactivates the code.

§4. Replacement and security of the code

  1. If the Gift Card e-mail has been lost or the code has become illegible, the Buyer may request a replacement by contacting sales@maxtondesign.eu with proof of purchase.
  2. The Issuer will deactivate the previous code and issue a new Gift Card with the same Balance, in the same currency and with the same expiry date.
  3. The Issuer may block a Gift Card code if there is a justified suspicion that it was obtained unlawfully. The Issuer will inform the Buyer of the block.

§5. Final provisions

  1. The Gift Card is a multi-purpose voucher within the meaning of the VAT Act. Its sale is not subject to VAT; VAT is charged when the Gift Card is used to pay for Products. The order confirmation sent to the Buyer is not a VAT invoice or a fiscal receipt.

  3. The Issuer may amend these Terms for important reasons, in particular changes in the law, technical changes in how Gift Cards are issued or accepted, or preventing abuse.
  4. Amendments take effect 14 days after publication and do not affect Gift Cards purchased before the amendment to the User's detriment.
  5. Matters not covered by these Terms are governed by the Store's Terms and Conditions and by Polish law. The choice of Polish law does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
  6. These Terms are available in Polish, English, French and German. In the event of any discrepancy between the language versions, the Polish version prevails.
